Trump bid to overturn election stumbles as judge tosses Pennsylvania lawsuit

Judge throws out Donald Trump's bid to stop Pennsylvania vote certification

As NPR previously reported, Rudy Giuliani, President Trump's lawyer, had argued that Republican observers were illegally denied access to ballot counting in Allegheny County and other Democratic-leaning areas and that the court should therefore invalidate almost 700,000 mail-in votes.

Even if he'd won the Pennsylvania case, Trump would have needed to win other lawsuits in other states where he'd also asked to delay certification.

Two Republican sources said a press conference on Thursday at which Trump lawyer Rudolph Giuliani accused Democrats of engaging in a "national conspiracy" to manipulate vote totals, while conceding that he had no evidence, may have been a turning point for some former allies.

Trump campaign announced on Saturday that it will seek "expedited appeal" following the dismissal of the lawsuit filed earlier in Pennsylvania that demanded to discard mail-in ballots in the state.

"In the United States of America, this can not justify the disenfranchisement of a single voter, let alone all the voters of its sixth-most-populated state", the ruling read.

"This Court has been presented with strained legal arguments without merit and speculative accusations", Mr Brann wrote.

In a blistering decision, U.S. District Judge for the Middle District of Pennsylvania Matthew Brann dismissed the campaign's lawsuit alleging that Republicans were disadvantaged because election officials in Democratic-leaning counties allowed voters to fix errors on their mail-in ballots. Lawyers' Committee for Civil Rights Under Law, the organisation that intervened in the case, said the court verdict has dealt another blow to the president's attempts to undermine the Election 2020's decisive results in the commonwealth.

In a follow-up tweet, Trump doubled down on his claims that Republican poll watchers were "not allowed to "watch", not even allowed in the counting rooms", again recalling "fake ballots and dead people voting".

President Donald Trump is facing a new setback in his desperate bid to overturn the United States election, as a federal judge dismissed a lawsuit filed by his campaign that sought to throw out millions of votes in Pennsylvania. Trump was said to be considering extending a similar invitation to lawmakers from Pennsylvania. He contends that granting the plaintiffs their requested relief "would necessarily require invalidating the ballots of every person who voted in Pennsylvania".

Trump's campaign argued that violated the U.S. Constitution's equal protection guarantee.

The judge dismissed the Trump action "with prejudice", meaning that the case can no longer be brought to court.

"These claims were meritless from the start and for an audience of one", Shapiro said in a statement. Democratic Gov. Tom Wolf will notify the winning candidate's electors they should appear to vote in the Capitol on December 14.
