US violated trade rules with tariffs against China: WTO

The World Trade Organisation has ruled that the United States violated the trade rules of the organisation by introducing high tariffs against Chinese goods as a part of its trade war against the Asian country.

Washington says tariffs it imposed two years ago on more than $200 billion in Chinese goods were justified because China was forcing companies to transfer technology and intellectual property. Washington had not then adequately explained why its measures were a justified exception, the panel concluded.

The US said the duties were a response to China's state-sanctioned technology theft, subsidies and other "unfair practices" and allowed under 1970s-era trade rules.

The European Union, China and a long line of other countries have launched a temporary system for appealing trade dispute rulings, but the United States is not participating. But I'm not a big fan of the WTO - that I can tell you right now.

Chines state media Global Times meanwhile hailed Tuesday's ruling and said in a tweet it hoped the U.S. would respect it and "take pragmatic actions to meet China and other WTO members halfway to enable a stable and healthy development of the global economy". "The United States, China and especially the WTO are all losers". However, that would put the case into a legal void, because Washington has already blocked the appointment of judges to the WTO's appellate body, preventing it from convening the minimum number required to hear cases. It also claimed the Trump administration had violated a dispute-resolution provision that requires countries to appeal to the WTO to settle disputes before slapping retaliatory tariffs on another country.

The panel was created in January past year to review US President Donald Trump's decision to hit China with tariffs on a quarter of a trillion dollars' worth of goods. Washington theoretically has the power to challenge the WTO's ruling on tariffs against China, which enables Beijing to legally respond in the form of imposing tariffs against American goods.

Noting "unprecedented global trade tensions", the three-person panel encouraged the two sides to work to resolve the overall dispute.

The WTO panel ruled that the USA measures violated longstanding worldwide trade rules because they only applied to products from China, and that Washington had not adequately substantiated its claim that the Chinese products hit with the extra duties had benefited from the allegedly unfair Chinese practices. Duties of 10 per cent were imposed on some $200 billion worth of goods in September 2018, and were jacked up to 25 per cent eight months later.

While the European Union has so far been spared US levies based on the controversial Section 301, the 27-nation bloc may breathe a sigh of relief over Tuesday's WTO verdict. "United States of America should withdraw and lead the effort to abolish it".

Trump, critical of multilateral institutions, has already quit the United Nations cultural organization UNESCO and plans to leave the World Health Organization.
