Dr. Rick Sams, who ran the Kentucky Horse Racing Commission from 2011-18, told the New York Times that the amount of scopolamine found in Justify - 300 nanograms per milliliter - indicated doping.

Justify's trainer Bob Baffert was reportedly told about the drug test nearly three weeks after it happened.

The article said that a lab at the University of California, Davis sent notice two and a half weeks before the Kentucky Derby that Justify had tested positive for the drug which is used to treat stomach problems in humans.

The report Wednesday said that Justify shouldn't have been able to participate in any of last year's Triple Crown events.

The documents reviewed by the Times showed no evidence of tampering by Justify's owners. That test confirmed the presence of the drug, though it was not returned until after the Kentucky Derby.

Four months after Justify became the 13th Triple Crown victor, the board threw out the drug test all together, citing that the test could have been the result of the horse eating jimson weed, which is known to contain high levels of scopolamine.

"There was no way that we could have come up with an investigative report prior to the Kentucky Derby", Baedeker said, per the Times. The board then opted to reduce any penalties levied for the particular banned substance Justify was found to have had injected.

Previously, failed drug tests that uncover scopolamine in horse racing have resulted in disqualifications, prize forfeiture, fines, and suspensions. "We weren't going to do that".

Justify won the Kentucky Derby, Preakness and Belmont Stakes as a three-year-old before Coolmore bought his breeding rights for $US60 million after his retirement.
