
A Cook County judge ruled Friday that a special prosecutor would be appointed to investigate the Jussie Smollett case.
A Chicago judge rules that Cook County State's Attorney Kim Foxx did not have the authority to appoint an acting state's attorney after her recusal from the case; Matt Finn reports.
"My advice was that First Assistant Joseph Magats seek the court's approval and request a Special State's Attorney appointment in this matter".

Chicago Mayor Rahm Emanuel and Police Chief Eddie Johnson are furious about Smollett's secret deal. Her office charged Smollett with 16 counts of disorderly conduct after police concluded that Smollett had staged the early-morning January 29 attack on himself and had paid two acquaintances to help him pull it off.
Former state appellate judge Sheila O'Brien petitioned for the appointment of a special prosecutor in April on the grounds that Foxx's decision not to charge Smollett, despite what police claimed was overwhelming evidence of his guilt, created "a perception that justice was not served here, that Mr. Smollett received special treatment".

The special prosecutor may end up bringing charges against Smollett in connection with the staged hate crime, Toomin said. But her office opposed such a special prosecutor, explaining that the investigation would just duplicate the efforts of a county inspector general's office probe that is already underway.
Foxx, who was supposed to represent the state against Smollett, announced that she would recuse herself because she knew one of Smollett's relatives.
Foxx has defended her handling of the case and said Smollett was treated no differently than thousands of other defendants in low-level cases whose charges have been similarly dropped since she took office.

Smollett will not appear on the upcoming season of Empire and his attorneys are now being sued for defamation by the Osundairo brothers, who claim they were hired by Smollett to stage the attack.
