California jury orders J&J to pay US$29 million in latest talc cancer trial

A few weeks ago, sources told Reuters that India's CDCSO had failed to find traces of asbestos in J&J's talcum powder.

In a statement, the company said it was disappointed in the verdict, and planned to appeal "because Johnson's Baby Powder does not contain asbestos or cause cancer". It's the first defeat since a Missouri jury ordered the company previous year to pay $4.69 billion to 22 women who blamed their cancer on the product.

The California Superior Court in Oakland agreed that the company's baby powder was a "substantial contributing factor" to her mesothelioma, a rare and aggressive cancer caused by the inhalation of asbestos.

Leavitt was diagnosed with mesothelioma in 2017 after using Johnson & Johnson's Baby Powder and Shower to Shower during the 1960s and 1970s.

Leavitt's doctors say her mesothelioma is advanced and she's not expected to live beyond 2020, according to testimony in the case. In December previous year, the company reiterated the safety of its products as a slew of drug regulators around the world such as the US FDA and India's Central Drugs Standard Control Organization (CDSCO) analysed samples of J&J products. This track record shows that there are one set of facts in these cases, and that decades of tests by independent, non-litigation driven experts and institutions repeatedly confirm that Johnson's Baby Powder does not contain asbestos or cause cancer.

Leavitt's trial originally included J&J's talc supplier, Imerys Talc America, a unit of Imerys SE, as a co-defendant.

Asbestos is a term for a group of minerals often found near talc, which is widely used in cosmetics.

The company has long argued multiple studies have shown the powder to be free of the carcinogen and that plaintiffs' cancers were tied to asbestos exposures at work or though building materials in homes or offices.

It cited problems with legal procedure and evidence, and said lawyers for the plaintiffs failed to show that the powder contains asbestos, noting that "their own experts concede that they are not recognizing the accepted definition of asbestos and are ignoring crucial distinctions between minerals that are asbestos and minerals that are not".

The jury awarded $24.4 million to Teresa Leavitt and $5 million to her spouse, Dean McElroy.

A Mount Sinai researcher wrote in a company letter in 1971 that he had detected a "relatively small" amount of asbestos in the baby powder.
