Spotify files EU complaint against Apple's 'anticompetitive' App Store rules

Apple Music costs 9.99 euros ($11.28) a month, the price Spotify charges for direct subscriptions to its own website and used to charge on the App Store before Apple imposed its own payment system and extra levy.

Spotify founder Daniel Ek said on Wednesday that the company has filed a formal antitrust complaint with the executive European Commission against Apple - a move that adds to the debate about how to rein in the power of big-tech. This in return leads to a price inflation of Spotify's Premium membership, causing the company to be unable to fairly compete with the pricing of Apple's own music streaming service, Apple Music. These include the inability to carry out proper customer support and being locked out of Apple services such as Siri, HomePod and Apple Watch. Before it stopped selling Premium subscriptions through the App Store in 2016, it had one of the highest-grossing apps in the US and around the world. Spotify had 96 million paying subscribers at the last count in February, while Apple Music reportedly had 56 million subscribers at the end of 2018.

Spotify has filed an anti-trust lawsuit against Apple accusing the latter of following unfair and uncompetitive trade practices that not only harm the competition but also limits the choice consumers can make.

Spotify's complaint apart, there also seems to be a consensus building in the United States about the growing clout that several companies has begun to exercise on the masses or the market. Amazon famously does not allow users to purchase books through its Kindle app on iOS because it does not want to give Apple the 30% cut on every book.

Ek points to the revenue share that Apple demands for services that charge customers via apps distributed through the App Store, unofficially known as the "Apple tax".

Ek says the company had tried - and failed - to resolve these issues with Apple before filing a complaint to the EC. The App Store has also continued to change on Spotify, where they are not allowed to show users other ways to pay or upgrade to premium services or offer promotions.

One example that Ek outlined in his written deposition, is the manner in which Apple taxes businesses that want to use their platform as a seller's market.

Ek noted that apps like Uber aren't subject to the "Apple tax", and that Spotify isn't looking for special treatment, just equal treatment. So, let me be clear that this is not a Spotify-versus-Apple issue. That's what competition on the merits is all about.
