A judge dismisses Stormy Daniels’ lawsuit against Trump – and there’s more bad news for her

She was discussing the way the president reportedly directed Eric Trump to handle the legal response to the claims and lawsuit brought by Stormy Daniels, who says she had an affair with Donald Trump.

Judge S. James Otero issued the order Monday, allowing President Trump to seek money to cover attorneys' fees if he so chooses.

Those comments, which Daniels' attorney Michael Avenatti called defamation, were just politics, the judge ruled.

"There is something really rich in Trump relying on the First Amendment to justify defaming a woman", Avenatti said. A judge threw out Daniels' lawsuit against Trump on Monday and is forcing her to pay his legal bills.

"No amount of spin or commentary by Stormy Daniels or her lawyer, Mr. Avenatti, can truthfully characterize today's ruling in any way other than total victory for President Trump and total defeat for Stormy Daniels", Harder said in a statement to the media.

The case is Clifford v. Trump, 18-cv-06893, U.S. District Court, Central District of California (Los Angeles). Trump has denied the affair took place, and cast doubt on her story of being threatened.

The defamation claim is separate from another lawsuit that Daniels filed against Trump, which is continuing. The president, who has continued to deny any relationship with Daniels, later lambasted her claims on Twitter, saying they were "a total con job, playing the Fake News Media for Fools (but they know it)!"

Upon unveiling the sketch, Stormy's lawyer, Avenatti, said they would pay a $100,000 reward for the identity of the man, and asked for tips to be sent to IDTheThug@gmail.com.

Harder argued that Trump's statement ought to be considered protected speech, and that Daniels did not identify specific damages.

Daniels originally sued Trump and Cohen, who negotiated the deal, so she could speak publicly about the reported tryst without fear of reprisal.

Daniels is also suing Trump and his former personal attorney Michael Cohen over the $130,000 payment made to her to keep silent about the alleged affair in the weeks leading up to the 2016 election.

In an interview with CBS News earlier this year, Stormy Daniels said a stranger approached her while she was with her young daughter and threatened her.

Daniels had said the agreement should be invalidated because Cohen signed it, but Trump didn't.
